Details

While a lot of study is still needed, jailtime is not. Prohibit the jailing of individuals caught with the outlined amounts of a list of psychedelic drugs. Psychedelic possession shall be considered a violation, or lowest level of offense defined in state law, and shall not show up on a criminal record.
Rights Restoration Act
To acknowledge the rights of a state and the individuals within, this law may be overturned and modified via a state referendum in which all members of the state above the age of 18 are allowed to vote regardless of criminal history related to psychedelic drugs.
Bullet Points
  • Advancement of scientific research: Decriminalizing psychedelic drugs would remove legal barriers that currently hinder scientific research into their potential therapeutic uses. By allowing researchers to explore these substances in a controlled and regulated environment, we can better understand their benefits and risks, potentially leading to new treatments for mental health disorders.
  • Reduction of criminalization and incarceration: Decriminalization would shift the focus from punitive measures to a more health-centered approach. Instead of criminalizing individuals for personal use or possession, resources can be redirected towards education, harm reduction, and addiction treatment. This approach reduces the burden on the criminal justice system and promotes public health and well-being.
  • Personal freedom and autonomy: Individuals have the right to make choices about their own consciousness and well-being, as long as they do not harm others. Decriminalization acknowledges the principle of personal autonomy and respects the individual's right to explore their own consciousness and make informed decisions about their own mental health.
  • Safer and regulated access: Decriminalization allows for regulated access to psychedelic substances, ensuring quality control and minimizing the risks associated with unregulated markets. By establishing safety standards, dosage guidelines, and quality controls, individuals who choose to use these substances can do so with reduced risk of contamination or unknown potency.
  • Potential therapeutic benefits: Psychedelic drugs have shown promise in the treatment of various mental health conditions, such as depression, anxiety, PTSD, and addiction. Decriminalization would facilitate further exploration of their therapeutic potential, potentially providing alternative treatment options for individuals who have not found relief through traditional methods.
  • Reduced stigma and improved mental health dialogue: Decriminalization helps to destigmatize psychedelic drug use and encourages open and honest conversations about mental health. It fosters an environment where individuals feel more comfortable seeking help and discussing their experiences, leading to improved mental health outcomes and reducing the associated social stigma.
  • Cultural and indigenous significance: Psychedelic substances have been used for centuries in cultural and indigenous contexts for spiritual, healing, and ceremonial purposes. Decriminalization acknowledges and respects these cultural practices, promoting cultural diversity, and recognizing the historical significance of these substances.
  • Economic opportunities and regulation: Decriminalization can stimulate economic growth and job creation through the regulated market for psychedelic-assisted therapy, research, and education. It opens up opportunities for entrepreneurs, scientists, therapists, and other professionals to contribute to this emerging field, benefiting both individuals and the economy.
  • Harm reduction and education: Decriminalization allows for the implementation of harm reduction strategies and educational initiatives focused on safe use, responsible behavior, and informed decision-making. By providing accurate information and resources, individuals can make more educated choices and minimize potential risks associated with psychedelic drug use.
  • International drug policy reform: Decriminalization by the United States could influence international drug policy discussions and encourage other countries to adopt more progressive approaches. It can promote evidence-based policies and encourage international collaboration in research, harm reduction, and public health efforts related to psychedelic substances.
